Terms of use

Draft under legal review.

1. Purpose

Bise Market, operated by [to be completed], is an online platform where private individuals and businesses list used board sports gear and conclude sales with each other. The platform is not a party to the sales contract.

2. Account

Registration is open to adults living in Switzerland or Liechtenstein. Each member is responsible for their account and the accuracy of the information provided.

Before listing, messaging or buying, each member verifies their identity with our provider Stripe: ID card or residence permit (front and back) or passport, plus a selfie. Documents must be valid and belong to the member.

Each person may hold only one account, for life. Opening a second account, including after deleting the first one, is forbidden. The platform may block payouts of a duplicate account and close it. After every sale, buyer and seller may rate each other; ratings are public.

3. Listings

A listing honestly describes the actual condition, with photos of the gear offered. Forbidden: stolen or counterfeit gear, listings unrelated to board sports, contact details or external payment methods in the listing. The platform may refuse, edit or remove a listing.

4. Payment

Payment is made only through the platform, via our provider Stripe. The amount is charged at purchase, then held on the seller’s Stripe account. It is paid out after the buyer confirms hand-over, after the hand-over code is entered, or 48 hours after delivery without a complaint. The platform never holds the funds.

5. Fees

Fees are described on the Fees page. They are owed by the buyer and not refundable, unless the sale is cancelled or a dispute is decided in the buyer’s favour.

6. Hand-over and disputes

When shipping, the seller enters the tracking number within 5 days of payment, otherwise the buyer may cancel. The buyer may report a non-conformity within 48 hours of delivery. The platform reviews what both parties provide and decides on payout, full or partial refund. The parties’ rights under the Swiss Code of Obligations are reserved.

7. Liability

The platform does not guarantee the quality, safety or conformity of the gear sold. Its liability is limited to damage caused intentionally or through gross negligence.

8. Personal data

See the privacy policy.

9. Applicable law and jurisdiction

Swiss law. Jurisdiction at the operator’s registered office, subject to mandatory jurisdictions.
